By visiting our website, using our services or placing an order with Duchique, you agree to these Terms and Conditions. These Terms and Conditions are subject to mandatory consumer protection rights applicable to consumers in Finland and the European Union.
Article 1 – General
These Terms and Conditions apply to offers made through Duchique and to distance contracts concluded between Duchique and consumers through our online store.
Before an agreement is concluded, these Terms and Conditions will be made available to the consumer in a manner that allows them to be accessed and stored for future reference.
Nothing in these Terms and Conditions limits or excludes any mandatory rights granted to consumers under applicable Finnish or EU consumer protection legislation.
Article 2 – The Offer and the Agreement
We aim to describe our products, prices and other relevant information as accurately as reasonably possible.
Obvious typographical errors, technical errors or other clearly identifiable mistakes do not bind Duchique to the extent permitted by applicable law.
An agreement is concluded when the consumer completes the ordering process and the order is accepted by Duchique.
After placing an order, the consumer will receive an electronic order confirmation containing relevant information about the purchase.
Article 3 – Prices, Taxes and Additional Costs
The total price payable by the consumer, including applicable taxes and other mandatory charges known to us, will be displayed before the consumer completes the order.
Any applicable delivery charges will also be disclosed before the order is placed.
Products may be shipped from outside the European Union.
Where import VAT, customs duties, customs clearance charges or other import-related fees may apply and are not included in the price charged by Duchique, this will be communicated to the consumer before the order is placed, as required by applicable law.
Any additional charges for which the consumer may be responsible will be disclosed as clearly as reasonably possible before purchase.
Article 4 – Payment
Payment must be made using one of the payment methods offered during checkout.
The consumer is responsible for providing accurate and complete payment, billing and contact information.
Where payment is authorised electronically, the transaction will be processed through the applicable payment service provider.
Duchique may refuse or cancel an order where payment cannot be successfully authorised, where there is a reasonable suspicion of fraud or misuse, or where another legitimate reason exists, subject to applicable law.
Article 5 – Delivery
Duchique will exercise reasonable care when processing and fulfilling orders.
The estimated delivery time will be communicated through the website, product page, checkout or order confirmation, as applicable.
Unless another delivery period has been agreed, orders will be delivered within the period required by applicable consumer protection law.
If delivery is significantly delayed, the consumer may have statutory rights to request delivery within an additional reasonable period and, where applicable, terminate the agreement.
The risk of accidental loss of or damage to the goods generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically receives the goods, subject to applicable law.
Article 6 – Statutory Right of Withdrawal
For most products purchased online, consumers have the statutory right to withdraw from the agreement within 14 days of receiving the goods, without providing a reason.
To exercise the right of withdrawal, the consumer must clearly notify Duchique of the decision to withdraw within the applicable withdrawal period.

After notifying Duchique of the withdrawal, the consumer must return the goods within 14 days.
During the withdrawal period, the consumer may inspect and handle the product to the extent necessary to determine its nature, characteristics and functioning, in a similar manner to what would reasonably be possible in a physical store.
If the product has been handled beyond what is necessary for this purpose and its value has decreased as a result, Duchique may make an appropriate deduction from the refund where permitted by applicable law.
Unless otherwise required by law or agreed by Duchique, the consumer is responsible for the direct cost of returning the goods.

Article 7 – Exceptions to the Right of Withdrawal
The statutory right of withdrawal may not apply to certain goods and services where an exception is provided by applicable law.
Examples may include:

Goods made to the consumer's specifications or clearly personalised;

Sealed goods that are not suitable for return due to health protection or hygiene reasons where the seal has been broken after delivery;

Goods that are liable to deteriorate or expire rapidly; and

Other goods or services for which an applicable statutory exception to the right of withdrawal exists.
Where relevant, information about an applicable exception will be provided to the consumer before the purchase is completed.
A product will not be excluded from the statutory right of withdrawal solely because it belongs to a particular product category unless the applicable legal requirements for the exception are satisfied.
Article 8 – Refunds Following Withdrawal
Where the consumer validly exercises the statutory right of withdrawal, Duchique will refund the payments received from the consumer in accordance with applicable law.
The refund will be made without undue delay and no later than 14 days after Duchique has been informed of the consumer's decision to withdraw.
Duchique may withhold the refund until the returned goods have been received or until the consumer provides evidence that the goods have been sent back, whichever occurs first.
Where required by law, the refund will include the cost of the least expensive standard delivery method offered for the original order. Additional costs resulting from the consumer choosing a more expensive delivery method do not have to be refunded.
Refunds will generally be made using the same payment method used for the original transaction unless otherwise agreed.
Article 9 – Conformity, Defective Products and Statutory Rights
Products supplied by Duchique must comply with the agreement and applicable consumer protection requirements.
If a product is defective, damaged, incorrect or otherwise does not conform to the agreement, the consumer should contact Duchique at:
Consumers are encouraged to report problems as soon as reasonably possible after discovering them. This does not reduce or replace any statutory period during which the consumer may exercise rights relating to defective or non-conforming goods.
Depending on the circumstances and applicable law, the consumer may be entitled to remedies such as repair, replacement, a price reduction or termination of the contract and a refund.
Duchique will not impose return costs for defective or non-conforming goods where doing so would conflict with the consumer's statutory rights.
Article 10 – Complaints
Complaints regarding an order, product or our performance of the agreement may be submitted to:

We will handle complaints within a reasonable period and will aim to respond as quickly as reasonably possible.
If a complaint cannot be resolved directly with Duchique, consumers may also have the right to contact the relevant consumer advice or dispute resolution body in Finland.
Article 11 – Liability
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by law, Duchique will not be responsible for losses that were not reasonably foreseeable when the agreement was concluded or for losses that are not directly related to Duchique's failure to perform its obligations.
Any limitations of liability contained in these Terms and Conditions do not restrict the consumer's mandatory statutory rights.
Article 12 – Force Majeure
Duchique will not be responsible for delays or failures to perform obligations caused by circumstances beyond our reasonable control, to the extent permitted by applicable law.
Such circumstances may include significant transportation disruptions, natural disasters, governmental measures, strikes, telecommunications failures or other events that could not reasonably have been prevented or avoided.
This provision does not affect any mandatory rights the consumer may have in the event of non-delivery or delayed delivery.
Article 13 – Privacy and Personal Data
Personal data collected in connection with purchases and use of our website is processed in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (“GDPR”) where applicable.

Article 14 – Changes to These Terms
Duchique may update these Terms and Conditions from time to time, for example to reflect changes in our Services, business practices or applicable legal requirements.
The Terms and Conditions applicable to an order are generally those made available to the consumer when the relevant agreement was concluded.
Material changes will not retroactively reduce statutory rights relating to orders already placed.
Article 15 – Applicable Law and Consumer Protection
These Terms and Conditions and agreements concluded through Duchique are governed by applicable law.
Where a consumer resides in Finland, nothing in these Terms and Conditions deprives the consumer of the protection provided by mandatory provisions of Finnish consumer law or other mandatory consumer protection rules applicable under European Union law.
Any choice of law will not have the effect of depriving a consumer of mandatory protections that would otherwise apply under applicable law.
